I'm in the same boat.. Only difference is my passport is expiring next month.
Presumably you are working with lawyers who can answer these questions.
You can get your passport renewed in 1-2 days. For that you have to get approval from consulate for premium processing and then you apply for h1b transfer
Visas remain valid on older passports. For convenience get new passport first.
So you can get the passport renewed in the US here. And you can get the new H1b stamped when you go to India next time.
If itβs a transfer of h1b and not h1b stamping then you are fine. Sound advice is to talk to your legal team!
Your H1B will be approved only till your passport is valid. So renew your passport in fast processing service and then apply. Else you can get your H1B extended after your passport is renewed but will cost the company again. I was in the same situation, went to the consulate and requested a one day turn around for the new passport and got it.
I was in the same situation. My attorney suggested to renew my passport first and then apply for h1b extension.
Renew your passport from an Indian embassy in the US. They're pretty prompt.
And I-94 also expires .
I think thereβs no problem if itβs premium processing. The lawyers should confirm.
