Supreme Court subverts the First Amendment

The highest court just gave law enforcement a green light to arrest critics. FTA: The court concluded that: โ€œThe presence of probable cause should generally defeat a First Amendment retaliatory arrest claim.โ€ On the specific facts of the case presented, the court held that โ€œ[b]ecause there was probable cause to arrest Bartlett, his retaliatory arrest claim fails as a matter of law.โ€ It's not nearly as wide reaching or inflammatory as the title suggests.

Probable Cause is very loosely defined and gives officers a lot of leeway. โ€œI thought I smelled weedโ€ is probable cause.
