So I checked SEVIS and seems like I am not selected for H1-B. My OPT will expire in July. My PERM just got certified and I am waiting for lawyer to file my I-140. Based on current processing time, I won’t get my GC EAD until Sept-Nov. Which means I will be placed with Work Authorization Suspension for a few months. Beyond losing stocks, what other implications that I should be worried about? Amazon immigration recommend that I look for internal transfer to another country but I prefer to stay and wait for the Green Card. Is waiting which being on work suspension a valid option?
file both i140 and i485 concurrently as soon as you can. Raise service request with uscis if ead is pending > 75 days. i got my gc-ead in 90 days. If background check goes smoothly, then u should get gc-ead in 90 days. Worst case scenario, contact senator to expedite your EAD.
How did you check and what do you see in Sevis?
Late in March, you should get an email from ice.dhs.gov to set up your SEVP account. After you log in, you will see your OPT details. If your OPT end date changed to 9/30, that means you are selected for H1-B. My end date did not change. You can search for other blind threads about this.
Some people’s SEVIS end dates are still changing, so be patient.
Green card is for a prospective job. Process can continue if you are on another country.
Can try O1 in pp
@Jezebel, I’m in a similar situation but my PERM is not even approved yet. It was filed more than 4 months ago. Can you tell me when your PERM was filed? I am really concerned that my PERM process is taking too long and I might have to give it up as I can’t be on work authorization suspension for several months.
my perm was filed in Oct and certified in April so it took me 6 months
Wow, that’s really long :( Well, if I were you, I would try to wait it out and go on work authorization suspension. At the same time, you could try to prepare a contingency plan with internal transfer to another country (preferably stay on the same team/org if there is a sister team abroad). Then if your work authorization suspension lasts more than e.g. 3 months and you still haven’t received the I-485 EAD, you could decide then to take the international transfer option. But you should start the contingency plan now and have it in place before you lose status.
6m is average. It’s a good timeline. If audit takes a year
Ok noob question. The lawyers at fragomen always say that you need h1b to get gc filed. How did you file on opt?
I know many people at Amazon file for gc while on OPT. It’s a back up option in case not selected for H1-B. But bcos now the processing gets longer and longer it is not working out as originally hoped.
Not a good idea, Amazon might fire you if USCIS took too long to process your case. I suggest do an internal transfer, you can always transfer back
If I transfer out, and then transfer back after a year, does my greencard process continue when I am in another country? Or do I have to start all over again after I transfer back?
I suggest you file your I140 as PP so it gets approved soon. Then when you come back, as long as you are at the same location with same title and pay, you should be able to file 485
