**Emergency VISA situation**

My registration was selected in the first round of the h1b lottery. H1b was filed by my employer in May, but got laid off in June. Received h1b approval notice in July but employer has already filed for h1b withdrawal with USCIS. Withdrawal is still pending. With Oct 1st being just a week away, if withdrawal is not processed,I will neither be on F1 (sevis auto completes) nor on h1b (withdrawal pending). DSO is aware of the full situation but unable to help without formal withdrawal confirmation from USCIS. Attorneys have not been able to help much either. If anyone is in a similar situation, kindly reply your next steps. PS - I am currently employed with a new employer on valid STEM EAD which expires in May 2025. #workvisa #h1b #rfe #layoff

Hereā€™s the thing if your H1B is not withdrawn by Oct 1st I think if itā€™s a change of status petition then itā€™ll change to H1B and you have to work for the H1B sponsoring employer. But if eventually it is going to get withdrawn youā€™ll have 60 days to find another H1B employer or switch to some other status.

We cannot file a transfer after USCIS adjudicates withdrawal. Transfer has to be done before adjudication

There is no way to find out when USCIS will take action but if you already have job, get H1B transfer immediately after oct1st. Anyway, you donā€™t have withdrawal letter so you canā€™t move to F1 within next 2-3 days. Better be on H1B going forward.

try doing a h1b transfer with your new employer and request the old employer to withdraw canceling if they can.. you can pay for it if necessary- should be a couple of thousand dollars at max..

Why would the previous employer want to spend more money to withdraw the H1B since it has already been approved? I am not understanding this.

Yes you can exit us and reenter your automatic H1B changes of status will be voided if you are not in the US. While reentering you can reenter on F-1 status just get a new travel endorsed by your dso. Not professional legal advice consult with lawyers regarding this.
