Summarizing s386 - why it is a crappy bill

Some ignorant guy was repeating the ImmiVoice talking points on s386, which are all bullshit. Let's look at the actual facts: This is the bill being passed off as just lifting country caps for "high skilled" workers, but it's really not doing that, it's doing much more. First, it applies to both EB2 and EB3 and while EB2 is high skilled (and we probably should take ALL these folks without any cap) EB3 is actually a low skilled category and includes loads of minimally qualified people. For EB3 it DOES make sense to have a cap, and a country cap makes sense as well--it's not about bringing in the most skilled (unlike EB1 or EB2) so since skill really isn't a factor bringing in a diverse group makes a lot of sense. Here are the EB3 requirements, right from USCIS: "Skilled Workers You must be able to demonstrate at least two years of job experience or training. Relevant post-secondary education may be considered as training. You must be performing work for which qualified workers are not available in the United States. A labor certification and a permanent, full-time job offer are required." Maybe S386 propaganda claims two years working experience (or just "training") after high school makes someone a rocket surgeon but in my books that is LOW skilled: https://my.uscis.gov/exploremyoptions/eb3_permanent_workers What's this mean in terms of who we are getting? Let's look at 2016, first at some normal employers: Facebook - 136k Goldman Sachs - 157k Google - 129k Microsoft - 124k Amazon - 125k Those are mostly going to be EB2 applicants including from India. EB2 had some fraud from India but for the sake of argument let's say the Indian EB2's are just as good. Looking fine so far. But now let's look at the wages paid by some Indian consulting firms: Cognizant, the #1 visa sponsor, $69k Infosys, $89k Hcl $101k Capgemini, $100k That is the shit tier of tech and almost all of that is coming EB3, in the low skill category. And then let's see, do we really just have tech on this list or are EB3 standards are so incredibly low that we're even bringing in FARM HANDS: House of Raeford Farms, $17k Koch Foods of Alabama, $20k Case Farms, $18k https://www.myvisajobs.com/Reports/2016-Green-Card-Sponsor.aspx Yup, the Indian consulting spam is coming through the same employment greencard the FARM WORKERS come on. Which brings me to the biggest piece of shit propaganda ImmiVoice pushes--that Indian skilled workers are on average more highly paid than noon Indians. Well, why might that be? Could it be that India just isn't sending any farm workers? Maybe because you can't bring a farm worker on an h1b and there's a backlog for India so it doesn't work bringing them directly on EB3 either. But because ROW has no backlog, farms ARE able to come directly on EB3, without having to go through a different visa first, so they do. So what we have here is the shit tier of tech demanding greencards because they are more highly paid than a farm worker. Paid less than ANYONE else in tech, because they are shit tier, but hey--more than a farm worker! So what's going to happen if s386 gets passed? The idea of to give everyone a EAD who files an i140, without needing any other visas. There will be no country cap on that, in fact, NO CAP AT ALL. Farms will literally be able to use EB3 to bring in millions of unskilled farm workers. Shit tier tech will flood the economy with $70k consultants. It'll be a disaster for America. And no, you do NOT need to get an h1b first so the "h1b fix" they yap about fixes NOTHING: people will skip filing h1b and file directly for i140 via "consular processing". Few do that today but in a post s386 world that will be the easiest way to get a work visa and millions, literally millions, will. And that's who s386 is a bullshit bill and everything you hear about it from ImmiVoice is a pack of lies.

Doesn't seem to change anything, though it's obvious Trump had some effect. But, you can still find low paid consulting services (you listed some) and while you pretended they don't exist the farm workers are still there. Plus unless you are proposing to revoke all outstanding i140s, 2016 is WAY more representative of the backlog--which is what we will actually be getting for the next decade. The 2019 applicants are a decade from the front of the line.

You got it all wrong. EB categories are not based on pay, they are based on experience. Even USCIS have not defined a shit of who a qualified worker is, so dont wreck your mind on it. An indian guy with MS from stanford and working in google as SWE is still not qualified to get green card immediately- he would have the same back log as that of any consultancy company.

I literally cut and paste the requirement from USCIS website. Under EB3 "skilled worker" just means two years of training or experience. EB2 is the category that requires any real education.
