Also have EB2 PERM I140 and now NIW I140. No publications or public accolades or anything so did not really think of EB1 before this but now wondering if it hurts to try. IS NIW the end of of the road? Obviously from a backlogged country so have to consider all this. EDIT: PD 2018. No PhD, only MS. 9 YOE. Some good referral letters for some good projects which led to the NIW
whats the impact of niw 140 on priority date?
EB2 NIW means you're locked in with apple as employer right? I don't think that transfers if/when you change jobs?
I did this. Same profile. Try eb1b with Apple. less relaxed criteria
Did u get it approved?
Yes. I am citizen now
can you give some tips for folks in your shoes, no publications/phd? did you have a lot of projects in critical fields like AI?
Don’t want to disclose too much because it could be easy to dox. But from what I have seen, any engineering field being worked on at Apple can be considered critical enough The real weight of the application was in the referral letters which validated my contributions to some projects and why those projects were impactful for the company and/ or industry (this is important because I don’t have publications or citations to prove this otherwise)
Sad no one here is helping you and are just asking random questions about their own situation. Like someone else mentioned, EB1A is almost impossible from the information you gave, no lawyer will take the case. EB1B might be an option if Apple is willing to do it, but still a very hard sell. NIW is 20x easier, so it's not surprising that it got approved.
I mean you need to realize that op is trodding an uncharted path. Of course there will be more questions than answers almost anywhere this question is posted.
Thanks for your reply Meta. It does seem like EB1 is a long shot for me but I think at this point I want to try because there’s nothing much to lose I was looking for people who tried this but looks like there are not many
Op I’m in the similar situation. Can I DM you?
We need to know a few more details on how your NIW was structured, to be specific, the types of evidence(s) submitted to prove that your experience and knowledge would contribute to the US economy. The EB1A category has a minimum set of requirements that you need to fulfill, for instance, evidence of international/national awards, published material in internationally circulated journals and/or media outlets, judging the work of your peers, etc., to name a few. There are a total of 10 requirements in EB1A, and you need to fulfill at least 3 to be eligible for application. However, be aware that being eligible does not mean guaranteed approval. If you think you satisfy most of these requirements and can produce sufficient shreds of evidence, you might have a shot. Since you mentioned you have good referrals, that would be able to satisfy one of the many requirements of EB1A/B (evidence of contributions of major significance to the field). But be aware that you might have to reach out to your referrals again, as letters might have to be structured in a different way to support your new petition.
Eb1 on what basis?
Updated post. I think EB1a is the only choice?
