Can I rent my house or my car while I am on H1B visa? The sharing services are attractive to make some extra bucks.
Legally you cannot but i have seen people who do that.
Why? Isn’t Airbnb income passive? I think it is okay but better check with a lawyer.
If you rent, that means you have an additional source of income and if you are in H1b, AFSAIK, you are not allowed to have any additional source of income. This comes straight from the USCIS laws. But i dont think there’s a way to check that so people usually consider it normal.
Real estate income is acceptable since you can own multiple properties on h1... Not sure through Airbnb but you can rent out if you have multiple assets.
I think I will get some legal help and educate all of us, eh..
Hey did you findout? Help a brother out ;)
Can you update this please?
I have done research on this. It’s very tricky. Sure you can earn on Airbnb. But that income should be passive. That means you shouldn’t be the one posting the listing, managing the tenants and responsible for upkeep of the property. Doing that violates H1 laws since you are technically working for yourself. if you hire someone todo all that for you. You shouldn’t be the person managing that hire. See tricky!
Does this same applies for Turo as well?
we can certainly do passive income stuff.Turo is all good too
on the IRS website, they clearly state what is NOT a passive income. And USCIS wants it to be PASSIVE. Working for something for more than 500 hours in a calendar year is Material(not passive) participation. Check out yourself. So if doing turo you think you haven't spent more than 500 hours in a year(about 1 day in a week), then you should be fine. What you all say? https://www.irs.gov/publications/p925
Asaik nope !
