I can’t even believe that I am passing through this. I live in Brazil and back to May/23 I applied to a position in US (to applied I filled many forms and mentioned that I would need a visa to go to US. I also mentioned that to all my interviews and to HR many times - all they told me to not worried because AMZ has an great immigration team and everything would be take care of. I accepted the offer, which included a international relocation package, had many meetings with tax consultants, relocation team, filled tones of forms, did the onboarding process, background check - and quit my job here in Brazil (my starting day at AMZ would be September 25th) - all the time people said that everything was fine and solid. Once again, the all this process started on early May!!! Yesterday I received a call from the recruiter saying the they would need to cancel my offer because they run out H-1B cap for the year without included my offer on it and they tough they could use a L-1 petition for me, but they were mistaken —REALLYYYY? WHY WAITING FOR 3 months to say that? I am so disappointed! This is such a basic error! AMZ HAS A ENTIRE TEAM JUST FOR IMMIGRATION AND THEY DON’T KNOW BASIC VISA REQUIREMENTS? SERIOUSLY? I am not blaming you but you shouldn’t have made big life decisions before getting the US visa. Try to reach out to hiring managers in other countries to see if they could take you on the basis of you previous interview scores. Also, reach out to your recruiter to see if they can help you in anyway. That’s the least that incompetent recruiter should do after this blunder.
1000% and you should have done your diligence on feasibility of each visa. Most hr teams everywhere are lazy and dumb. I’ve even corrected my immigration papers for tn visa in the past
The worst thing is that - I checked before quit! I directly ask the question about the visa! An the recruiter told me that immigration team was giving me a H-1b (now I know it is a lie!). Don’t get me wrong, I did not quit just after receiving the offer, I did all the paperwork wait until the begging of this month and quit.
There are thousands of citizens laid off here in USA, how you think Amazon can pull this fraud getting foreigner ignoring local laws? Sad that you fell for it.

I am not a local, so I not aware of local visa legislation. I am also a very high qualified person, as I mentioned, all the time they told me it was ok- no issues, I even had meetings with Deloitte for tax requirements and so on - they took 3 months to noticed that they would need a different type of visa? Do you believe that is acceptable? I don’t think so!

It sucks but everyone should know that this is quite common. You have to understand and stay on top of the immigration system yourself. HR isn’t really that focused on immigration. They consult immigration lawyers but so much is often lost in translation.
Sorry OP. Anyone transferring or getting a new visa should wait for approval before quitting existing job. Looks like the oversight was caused by immigration firm Amazon contracts. HR and recruiters are not the experts in that. All visa holders in general need to be well versed in immigration laws also to avoid scenarios like this. Did they explain why L1 is not possible? Can you ask for a direct call with immigration attorney that worked on your case? Hope you land something soon.
For an L-1 you would have had to be employed by Amazon in another country for a continuous year. It is a bad time now with Amazon pushing RTO so hard. They really want engineers to be warming chairs in the office with their team.
Usually, your case for H1B should be ready before April 1st. This year was an exception, because the gov is clearing the queue. This was the reason why you had a chance to receive H1B later. If you weren’t familiar with this, you lived in an isolated bunker. When the cap was gone (in normal year, this would happened before your offer acceptance), they informed you that they don’t have a possibility to support you anymore. This was your fault to not be interested in the legal side. Also you should remember, that offer can’t guarantee acceptance of your H1B visa. The consul may reject your request after an interview in an embassy.

The Brazil HQ is 15 minutos walk from my place, I asked if I could start working from here and after one year be transferred - they mentioned that this is a corporate position and must be located in Seattle or Arlington.
What you should do now is look for a position opening in Brazil HQ and apply to it. For a position with the same level and role, our existing inclined loop would make you eligible to be hired through team match only, meaning just meeting the hiring manager. You could then take that job, and after a year apply to a different job in the US as an internal transfer.
