If you understand the rules, you seriously would not want apple following the rules. Following the rules makes things much more difficult for Americans. Would you prefer if half the job posts you see are fake? Perm rules require "prominent" fake job ads for roles already filled by visa holders. Apple is never going to give you that role. I've written those job ads and they're a ridiculous waste of everyone's time, including that of American applicants.

Absolutely. If long term US residents were allowed to change jobs without a green card, or could more easily get a green card, *that* would benefit wages. Currently, we're competing with people who are locked into low pay and can't move. Post layoffs, the jobs that were available and the pay scales offered were clearly targeting people in desperate visa situations. That wasn't apple. The whole premise of the article, "discriminates against *residents*," is wrong.
A slap on the wrist. They need heavier sanctions. I’ve been laid off and I’m applying for jobs and my resume and experience exactly matches a lot of these jobs yet automated rejections abound. I am a U.S. citizen (born in the US) extremely skilled, have a degree from a top university and I have lots of experience. I am also a veteran! Why the hell can’t these companies at least give me a phone screen? Oh I know why, these job postings are a sham, and they are there solely for PERM. I will use what H1Bs don’t have - my VOTE and vote for whoever will put an end to this, and reform the system so skilled, educated VETERANS and other US citizens get a shot. Republicans have to also fix their stance on college tuition and student loans. I got my college paid for with the GI bill and a private scholarship but many don’t have that opportunity. In state tuition should be free for residents, particularly low income. Fix it!!! TC: laid off

But why would Apple prefer visa workers? Is it because they ask for lower salary? It is not that they couldn’t find anyone in US since they didn’t even interview anyone in US for this job.
Lower salary and they are stuck there. Visa workers also require consistent high performance. In my company if you are on PIP you can’t get PERM. So they crack the whip.
Its called indentured servitude.
This is not a surprise to anyone who works in tech. All the FAANGs, Magnificent 7 and other large players engage in this while pushing out citizens
The job ads requirement is a stupid rule. Why you ask? Hint: it’s not to discriminate against Americans. If you were Apple, would you rather keep the *employee* who you know has been doing good work, or spend a lot of effort interviewing then replace him with someone who may not do the job well?
The whole system is stupid. I’m in favor of a wholesale reform of H1B. Companies need to seek out citizens and there are many of us who can do the job as good as or better than a visa holder. I’ve worked with visa holders who had lots of credentials from Indian universities yet they can’t figure out basic stuff. Loads of hand holding. And this saddens me because I’m also Indian (but US born). Indians aren’t exceptional by any measure. They are just willing to do the same work for less.
I tend to agree and the best thing we could do is provide a path for BS, MS and PhD non perm resident graduates of US accredited 4+ year universities that does not involve going through H1B. Then H1B could be reformed.

I wouldn’t expect anything less from Apple. Tech companies as a whole are pulling this type of nonsense, and it’s made searching for a job after a layoff more difficult than it needs to be. There should be a lasting punishment for corporations like this; they shouldn’t be able to buy their way out of a major infraction like this, especially since $25M is pocket change to them. As long as corporations are able to operate with wanton disregard for the best interest of the public while appeasing shareholders and investors, we’ll continue to see this type of behavior. TC: 105K
Corporate fines have the same ceilings for startups and Fortune 5 alike. Well known problem. Solving it would require judicial reform to progressive maximum penalties. That's not gonna happen.
Other solutions exist, like making H1B for truly exceptional, needed workers. For example WITCH should never be able to get a H1B.
