TL/DR: This past weekend I got stopped by a state patrol for a DUI check. I passed the Sobriety test and blow/BAC (blood alcohol concentration) test. No previous records or tickets. Can someone help with the next steps? I was driving home around 1 am, I had 2 beers and danced all night. I got pulled over in a 60mph zone and the officer said I was weaving and under the speed limit (55mph). My partner was passed out in the passenger seat at this point and as soon as the officers saw that, they had me get out of the car and do the field sobriety test. I passed the sobriety test but the officer insisted on a blow test. I refused to do, so I was handcuffed and taken to the station. I made a call to a public defender and got input on the next steps. I ended up blowing a **0.078** and a **0.076** which is less than the legal limit of **0.08.** The officer seemed upset and said that my alcohol levels decreased due to the time gap between when I got pulled over and given a blow test (close to 2 hours). He mentioned that the court would backtrack the levels on an hourly basis. And then the officer got my fingerprints and released me. The officer didn’t provide any case details and stated that it’s upto the court to dismiss the case or proceed on the hearing. If the court makes a decision I would receive the docs by mail. Right now I just do have the blow test results. Is it true that the court will backtrack? Looking for any advice or if anyone knows what I'm in for. P.S. I'm on h1b visa living in the WA state for 5 years. Did reached out to the attorney, he said that I have to receive the case details from the court and then can proceed with the next steps Edit1: Did reached out to lawyer and he said there is no case as of now. The courts/prosecutor will decide if the case need to be dismissed or proceed for hearing. Till then I have to be patient. TIA.

Get a lawyer. It'll cost you 5k~, but you'll get off with reckless driving or less.
Get a lawyer (not public defender) that specializes in DUI cases and is from the town/county/area where the dui took place. They’ll know how everything works, how the different judges operate, and can potentially get you let off with something less

My husband did this in Oregon just a few months ago. $5,500 for a lawyer, DUI classes, and drives with a monitor that he has to blow into. All in all, it will be expunged from his record after about 7 months of proven sobriety. Total out of pocket so far is approx $7500. Lots of small fees here and there.
You did the right thing refusing the test on the road. The court goes by fact and what your numbers are not what numbers could be. The pig is trying to scare you, but to be extra safe check with a reputable attorney.
