Professionals are expected to be reasonable. If you’re pulling dodgy moves based on legal technicalities or unreasonable expectations people will remember and you never know who you’ll cross paths with in the future. Maybe you get another job, but then one day somebody in your current orbit gets hired into the same company later and spreads word of what you did.
Damn if I can get paid to do nothing for one year I’d take it too. You better have a damn good reason. Are you pregnant? Do you have surgery? Do you have cancer?

You could delay PIP by a little while by going on FMLA. Definitely not for a whole year

A year is an example, I forgot the max. And anyway this would be justified with some valid/medical reasons of course
FMLA grants 12 weeks of leave (unpaid). Beyond that would be at your employers discretion, so “valid/medical reasons” go out the window. I have seen people use medical leave to delay PIP so many times but it always ends the same way.
