Situation: My company initiated my GC process and filled my PERM in Dec 2020. I recently got to know that my PERM process was completed and now my attorney is asking for the next step ie filling i-140. I am planning to do that under premium processing. Question: Before the attorney starts the i-140 process they are asking if there was any change in my job role within the same company in terms of compensation, work location, or job duties. My PERM was initiated and then I switched roles within the company from an analyst to a Product Manager. My work location remains the same but my compensation and job title have changed to some extent. Is that okay for i-140? Should I provide the details to the attorney? #perm
You will have to go through perm again as the job function has changed.
You'd need a new PERM but the lawyers can go ahead and file your I-140 to lock in your priority date.
Thanks. The only reason I am a bit concerned because I need to file my wife's H4 EAD. Hope re-applying/new PERM after i-140 shouldn't be a problem?
So many layers to this so your attorneys might be better placed to respond. No one knows what the new PERM process will be like. Probably delay the I-140 filing..?
File the I 140 so you are in the queue. Another perm process will take another 1yr and you will lose so much time in queue.
Talk to lawyers. Pay and Consult external as needed. Change to job requirements need to be added. Better be clean on any forms you sign. Assuming your PD is not current, it wouldn’t affect much.
You should be fine, it doesnt look like a material change. But let the attorneys know .
