Day1 cpt MS application after completing a PhD

Hi, I already have a PhD from a US university and currently working fulltime on F1-STEM OPT. Unfortunately this was my last year at H1 lottery and I didn't get picked. I am thinking of applying for Day1-cpt program to continue working on the side. Since I already have a PhD, I am wondering if I can opt for another MS program again, or do I have to go for another PhD to avoid any potential problems with my visa. Kindy advise me! "OPT at a higher degree level. For example, if you complete a Phd, then use OPT, and then complete a Master's-level program, you will not be eligible for OPT for the Master's level. You must be in the U.S. to apply" Straight from university of Chicago website. Sorry but get ready for O-1 or another country.

What would be the point at the end? Spend more money for 1 more shot at a silly lotto? The point is he is no longer eligible for opt. So he has to get picked for h1 before graduating.

Hello all! thanks for replying. Just to put a little more clarity I am currently using up all the OPT days after finishing my PhD. The sole reason behind going for day1 cpt program is so I can buy some more time before my profile gets little better to succesfully secure a O1 petition. I am not looking to use another OPT after day1 CPT program ends. Just wanted to make sure if persuing MS in day1 cpt after PhD is valid/legit in terms of immigration rules.

I think you should not have any visa/RFE issues if the Masters you are planning to pursue is in a different field of study and not the same as your PhD. However, you should also keep in mind that the new Masters should be relevant to your current job. For example, say you work in fintech and have a PhD in Computer Science then a masters in Finance or an MBA is acceptable by USCIS but not an irrelevant field of study such as Masters in Public Policy. In the end, it all depends on your lawyer as to how they will spin this new Masters on your visa application.
