Do I need visa stamping?

Hi, I currently work on H4 EAD which expires in August. My company filed my H1b and it is approved. I will be working on H1b visa starting October 1st. The attorneys (Fragoman) aren’t responding to my queries so I am going to reach out to someone on Avvo. Thought to check here as well. Question: I am required to travel to Europe in November for business. Do I need to get my H1b stamped before I can re-enter the USA or I can re-enter based on the stamped H4 visa on my passport? Yes, if you want to enter on H1 status. If you use H4 at POE, your employer has to file a COS from H4 to H1. Check with your attorneys and escalate to HM if they don't respond.

If you want to work on ur h1, then you will need your h1 stamped. I am guessing your h4 gets invalid from October.

With my hell lot of experience in this area, here is the report. Your H4 EAD will be automatically cancelled from Oct 1st. You will be on H1B status from Oct 1st. You can have H1B visa stamp any time. But I would recommend you to go for stamping after Oct 1st.
