Does anyone else feel annoyed that functional managers and people manager from outside USA qualify for EB1 with just 1 YOE? But it is not applicable for an employee who became functional or peoples manger while in USA, even though they hold these positions for years and years and they have studied from USA universities. #tech #faang #amazon #meta
They have no special skills which differentiate them from someone who grew here. Other eb don’t do this. Even eb1a or b is also fair to an extent

People are just asking for a fair chance or criteria. 99% people commenting here have had someone immigrate to America in last 5 generations. It's a discussion forum and saying "go back if you don't like it" literally means what?? All people want is a fair treatment whatever category they are.
Legal is NOT ethical. It's the hardest truth of life. Hence, life is unfair.
why do you think being a functional manager or people’s manager is more important from an immigration perspective than being an individual contributor? I know many dumb people who are managers, but then so many smart individual contributors. You are annoyed because the system doesn’t favor you. Get the f off here.
Yes this is definitely a problem that needs to be resolved. Folks who graduate from American universities should be given preference. It is very easy in some countries to be a manager leading 50 or more people. This may qualify some international candidates for the EB1 visa, but it definitely requires scrutiny. Being a manager in one country doesn’t mean you will be a successful manager in a developed nation like the US. I understand that this is a difficult evaluation to make at scale, but then the focus on immigration should change to US educated or US experience based talent. It sucks when we come across unqualified managers and the EB1 pipeline for ‘supposed’ executives doesn’t help drive innovation. Rather, it brings politics and stifles the growth these immigration policies were supposed to drive. Guess people always find ways to take advantage of systems meant to be beneficial ex. Tax laws for business growth.
