I have masters in industrial engineering with 105 citations. Have 9 papers and one chapter. Two first authored papers. Two patents applied, one approved. 7 years of experience as a software dev. What are my chances of approval for EB1 and need some good attorney references. Also I have been hearing even EB1 is pretty much useless for Indians given the current backlog. What is your take on that? #eb1 #h1b
Just to clear things up, you have three different categories in EB1 (A, B, C) each one having its own set of minimum requirements you need to fulfill. I will skip EB1C given the nature of the post. Based on the information provided about your accomplishments, pursuing an EB1A visa may be challenging, as this subcategory requires demonstrating "extraordinary ability" in your field. The number of citations will not be able to carry the profile alone, you would need to check multiple requirements for a better probability of success (more than 3/10, the higher the better). EB1B, on the other hand, could be a viable option for you to explore, provided you have a minimum of three years of research experience. You must submit substantial evidence documenting your research work and accomplishments. I would advise consulting an immigration lawyer as my comment is based on my personal experience and I have been wrong before.
EB1A - Good chance. Consult a good lawyer and start preparing. Worth a shot.
Follow these on LinkedIn : Aditi Paul, Soundarya Balasubramanyan .. they've all secured EB1
The second name is O1
Are they Einsteins?
I got my GC through EB1A. You haven't listed anything proving you are at the top of your field, the way to do that is to show that you judge work of others in your field. I was on the editorial board for a few high impact journals and got letters from their chief editors. Always compare your work to others to prove your are at the very top.. the entire packet will be competitive. Based on the average citations for publications in my field, at X citations I am in the top Y% Recommendations X and Y show that my patents are used in Z products and impacting W% of US or something.. Gives you the idea..
I did the same, eb1a. I also reviewed a ton of other people's scientific work for journals in my field, that made a difference. I also got letters from folks who cited my work about 14 such letters showing my work was seminal and helped them further advance the field.
It’s oddly comforting that a legit genius is employed by Chewy.
My friend moved from eb2 to eb1, i think he ported his date as well got GC right away. He used services from Wright law firm and said they are pretty good.
What were his EB1 creds?
EB1A is definitely possible (at least under the current admin). I got mine through that. I self-filed as no attorney was willing to take my case without a PhD, and I only have a Masters degree. You need to meet at least 3 of the 10 criteria mentioned in the uscis site. Usually, papers / citations and patents (especially if those have been cited and used to build and patent stuff by other firms) can make you match 1 or 2 criteria. Reviewing papers is another thing you can do to meet another criteria. High salary is one more that you can try and show (should be easy to show if you are on H1b). Edit - definitely follow what Chewy has advised above! It is spot on. Ignore those who say it is useless. You need to look at what's best for you. Don't go by the opinion of others. As far as EB1 being useless, I definitely don't think so. You can port your EB2 PD if it is already filed. Even if not, it'll be WAY faster (and will actually happen in the next few months / years) vs. EB2 or 3. Good luck!
You succeeded at self filing?
Yes
The current PD for India for EB1 is Mar '21, compared to other categories being '12. It's still worth giving a shot.
Hey I got my Eb1b and O1 too
My suggestion is to wait till 125 citations especially if it’s is NSC and how many peer review you have get it to 60 peer reviews and serve in conf program committee
