Sick n tired of the wait. What should I do? TC 250K
Stay in US and prepare for EB3 downlevel OR Go anywhere and use EB1C after a year OR Stay in US and try EB1A/B Any other US option is ridiculous. Option 1 is not possible for many with later PDs
Where did you see that? Jan 19 bulletin says Apr09
OP is talking about his/her priority date.
While for most GTFO is the right option, for OP with a PD of 2010, he's very close. Just wait for a year or two, you'll have it.
More like 8-10 years
Do you even read Visa bulletins? Even with the worst regression that can hit in 2019, sep 2010 PD is not far.
Thanks guys. EB1 A/B is not a possibility. The attorneys evaluated my case and said I have a 20-30% chance. For EB1C, I need to spend 1-1.5 years outside, then another 2-2.5 years of wait since MsFT will not file i140 in premium. That’s a total of 4-5 years even if I take the EB1C route. Moreover wife has a job here and can’t sacrifice 2 H-1Bs. We have a kid and it’s a huge risk moving lock stock and barrel. Waiting in line for another 4-5 years, optimizing TC and going on nice vacation to break the stress seems to be the only option :(
What did the attorneys say about downgrade to EB3 ? It’s almost certain to cross EB2 dates in due course of time
Downgrade is a possibility, but no action needed from me at this point in time. When dates cross Sep 2010, they will file a new I140 and downgrade. I’m hoping they file the 485 concurrently so I can get my EAD. This is because I can’t file i140 in Premium since am using perm from older eb2 petition. If they don’t concurrently file 485, waiting New i140 approval is 1-1.5 years without premium and dates certainly will retrogress and I’ll not be able to file for EAD.
If date of filing goes past your date you can 100% file 485 and get ead. But GC will take a lot longer. Hopefully you can get ead by 2020 if date of filing goes all the way there and the CO allows you to use this date to file. If you travel frequently then the AP is a hassle as it is always mandatory secondary inspection. Only good thing is avoiding stamping
You waited so long it’s just a matter of waiting until may be another year for your EAD to arrive at the least. That should take stress off you. Imagine people who have filed for GC in 2014, 2015 etc. it’s a forever wait for them. Make good money and enjoy your time here. Good times are coming for sure.
Thanks bro, makes me feel better already!
OP why don’t you internal transfer to MS London?Your wife won’t have to Give up her career there?
will take another 4-5 yrs bfr you get gc on hand. this is as per CO.
Can’t transfer to London easily. Amsterdam is an option. But salaries are very low there and tax rate is 45%. Losing 2 H1s to get a GC seems tricky that’s why am not too keen on moving. Even if I move, there’s no guarantee I’ll be able to find a job to return that will sponsor my EB1C. Just hoping EAD arrives by 2020 or 2021 latest and I can be at peace. Don’t care about GC really. Just need the H1 burden off my back.
What is the criteria for getting an EAD?How many years after filing for green card do you get it?

Is meta really worth the wait?
Depends on what you want: 1. Career stagnation but high money -stay in the US 2. Easier life but 1/3rd to 1/5th of your pay-Canada/Australia 3. Potentially rewarding career but unpredictable-India Go to a middle ground like London or Singapore where you can have a bit of everything
Do you know how difficult the immigration path in UK is? US is easier compared to that
It is not tough.I got an offer in the U.K. recently.Getting your first job is tough but will be relatively easy from the US. After that it’s 5 years to a residency.Since OP is in Microsoft he can just internal transfer to a team in London.
