F1 OPT -> H1B

Hello all, I’m trynna find an answer to this. I am currently on my OPT, my company entered me into the lottery for this year, so I’ll know if I get it by March 31.2024. I am also interviewing for a different role with another company, if I move to that company and let’s say my lottery gets picked. Can that other company complete filing my H1B within 60 days from March 31? My understanding is you have 60 days from the day it gets picked to company filing it? .If so, Does it matter if one company enters into the lottery and another files it for me? Appreciate answers thanks #2024H1B #2024H1B #h1b

It’s based on the company. If you get picked up, the new company will have to transfer.

Thanks, so transfer post October ? Or transfer within that period to file after March 31?

Probably mid November is the earliest you'll be able to move since you also need 2-3 paystubs once you're on H1B

The company through which you enter the lottery applies usually. You transfer after you secure the h1b come october

Nope it don’t work that your h1b lottery selection doesn’t mean it’s approved. Once it’s approved meaning once your company filled petition and then uscis approves they you can switch/ transfer.. earlier it used to be only possible after October but recent days I think it will be possible after you get approval but just you got selected in lottteay is not possible I am not lawyer so double check but this will be correct

No, new company cannot file for h1b before November. The company which files your initial application has to complete h1b registration before June if you get picked
