FAANG not sponsoring me for H1B

I went through the interview process for a position as a pre-sales engineer. Got the offer and accepted it. I need an H1B and go through the whole process of the lottery which means I wouldn’t be able to join till October 2019. Immigration team went back to the recruiter and told her they can’t do the visa cause they have capped the number of visas they apply for every year at FAANG (or smth like that). So my best bet would be to go to FAANG in Canada or somewhere else and (if i want) come to the states after one year. I have a feeling like visa application isn’t the problem but rather the fact they might not be able to guarantee me the position till October next year. Which makes sense to me, can’t judge them. My questions are: 1. Have any of you had a similar response recently? 2. If I go to, let’s say Canada. How easy is it to transfer to USA after 1 year? Is that really a thing or does it usually takes more than just that? I don’t really want to move to Canada, I would do it if I can come back to USA after 1 year. Otherwise, I prefer to move to Europe and stay there for longer. Thoughts? TC: None

I think this is the situation - even if they apply the visa for you and everything works out, October is the earliest when you can start working. They want you to get started earlier than that instead of waiting as long as that. If this is the case, it seems very normal to me. This is not related to any recent changes in immigration policies.

Just wanted to add that it’s not that they are not sponsoring you, just the wait is so long that they want to get you working earlier. Please correct me if I misunderstand your situation.

You are correct. I think the real reason is that they want me to start earlier. Which works out better for me as well since I can join sooner. I just don’t want to live in Toronto 😂 Thanks for your feedback!

Each company can only hire 15% workforce on h1B visa. After that, USCIS need to audit each case. I lost the chance to make few millions dollars due to this issue.

A company above a certain size with more than 15% of employees on H1B is known as a H1B dependent employer and is subject to additional paperwork when applying for the visas.

No. Just the law. Employer sponsorship is for positions that can not be filled with citizens. Unfortunately it’s abused and used for cheap labor.

Yes, just work for your FANG company anywhere in the world and you will be able to transfer to US a year later under L1 visa. There's no lottery for this visa, if your company sponsors you will get it. Downside is that you can't change employer.

Canada thing means that they will bring you back on L1. Minimum requirement to file L1 is to have worked atleast 1 year abroad and then they can transfer you to US. So 1 year thing is real, although it will take u around 1.5 as process will start after 1 and these days can take upto 6 months. One potential benefit is if u have a managerial post with ppl reporting to u or can be proven as functional manager, they can bring u in on L1A which potentially can FastTrack u for greencard.

Yeah, i figured it would take more than 1 year in reality. I just don’t want to be stuck in Canada for 3 years. I would prefer to go to Europe and stay there for ever if that’s the case.

I have no idea if there is a hard cap but from what I see in the news, Trump is limiting H1B visas for tech companies. I agree with the other advice on here to go for the L1 visa transfer after working for the company abroad. They are much easier for managers to write since you can use all your company specific domain knowledge to justify it. The ones I’ve submitted for people have come through fairly quickly.
