Hello! My wife was recently laid off and her employer (company listed on NASDAQ) has offer to pay for the return flight. If she decides to take the flight ticket and then gets another job within 60 days of grace period, will she have to repay back the cost of fight tickets to her previous employer, since she won't be boarding the flight? TC: 140K #layoff
That would be the last of my worries.
We have planned everything out. Once she gets back to home country, I'll file for her H4 visa via consular processing. So, we'll have little vacation at home and her quick status change to H4.
It's obligatory for the company to pay for the ticket back to home country, regardless if she decides to stay or not.
So is it no brainer to accept the flight ticket?
Accept the flight ticket. If you don't, the company has to have her sign some paperwork stating that she declined the offer.
Accept it. I don’t know if they have any legal recourse to collect. Also how would they know if she accepted? Are they running a background check after employment? I believe that is actually illegal.

What visa she is on? Why do you want her to chnage to H4? Can't she find another job in 60 days? Is she OK changing her visa to H4? If you only have to provide bill just book and show them, I don't think anyone will check did he/she actually went back. Everyone has theor own shit to do.
