My friend got laid off when he was on vacation outside US. He's on h1b and lawyers tell him that he cannot travel back. He want me to sell his car and belongings and empty his rental apartment. Why is h1b so damn fragile?
The system is fucked up. There is no humanity in US immigration.
What is stopping him from coming back ? Use latest payslips and come back immediately right away
And risk being banned for life from US for lying?
Isn't he in notice period ?
come back on b1b2
No visa appointments available for atleast 1 year from now
If he is Canadian, he doesn’t need stamping
He’s not going to be banned he literally can just come back as soon as possible
How do you know?
How will immigration know he’s been laid off like cmon
Immigration just needs to call your company to verify. It's no big thing. It's done randomly per lawyer.
At the port of entry, people are currently being asked to prove that you are not laid off by showing a recent employment letter or pay stub
Can he not come back as a tourist?
Yes he can, if he has the tourist visa
He can try getting interview dates for tourists visa
It takes a while for systems to update so pls don’t sell his shit, also if he finds a job in the next 60 days they’ll just transfer his h1b and his travel won’t matter he can just come back within those days these damn lawyers
You inherited his belongings by way of being a friend.

Whoever saying lawyer is wrong don’t know shat about visa and port of entry interview. He may lie his way through but if got caught he would be banned for a long time. Any lawyer wouldn’t recommend doing that. And what would he achieve by coming back? Job market is anyways dismal. You’re taking all that risk for nothing
This is absolutely true. Every single time one enters, they are actually applying an authorization to work in the US sponsored by so and so and under so and so terms.
What lie if they don’t ask him ??? If they ask why are you coming back - He is still on h1b
He got laid off without the required 60 day notice?
Yes, no 60 day for him as his site did not have more than 50 folk laid off. And no other office location within 50 mile radius. So no warn
Sucks. Why can't they do the notice for people on visa instead of severance period.
