Amidst mass layoffs the US govt allows companies to hire Visa Workers without proving they first tried hiring US workers
Hello - I would really appreciate if you read this post and help me with my questions. My TC 224k. my PERM application is still in progress. The priority date is 09-Jan-2023, and my H1B is expiring on 11-Jan-2024 (6th year expiration is Oct 2024). Spouse’s 6th year of H1B expires on 05-Feb-2024 and we haven’t been able to file for H4 EAD because my i140 hasn’t come yet. My immigration firm waited for PERM to arrive so they could do i140 as premium and then do my H1 extension, spouse’s H4 and H4 EAD together as premium but now as it hasn’t arrived yet (my PERM), they want to go ahead with my H1 extension and spouse H4 only. Question 1: her employer JPMorgan wants her to resign. Is it feasible for her to go on unpaid leave until the EAD comes? Question 2: if her H4 is approved before her H1 expires, can she still work on H1 until the expiration date? Question 3: how long would it take for EAD to arrive if applied separately after my i140 is approved? Question 4: she will anyways be on Maternity starting Feb 2024. Say she has to resign from her job and then want to restart her career after 5 or 6 months from Feb 2024 (after EAD is received), will the gap impact her prospects of getting a job.
