My girlfriend is in canada on work permit and is going to get her PR by the end of the year while I am in USA on opt. She’s planning to move to USA to settle down with me. She need to wait for another 2-3years to get canadian citizenship and move to USA with TN visa. Or she should apply for jobs sponsoring h1 leaving canadian citizenship( i know its hard) Is it worth waiting 2-3 years for citizenship and moving here or is it advisable to move here immediately leaving citizenship? Is TN visa better than h1? Her current citizenship: indian
Better to wait so she doesn’t have to deal with visa stuff
I don't think you understand the "visa stuff". She needs a work visa or gc to live in the US. OP and hi gf have a couple options. 1. Get married. She can them join him on H4. 2. She gets her own job and gets an H1b. 3. Sh waits for Canadian citizenship and the applies for jobs and uses a TN. TN is non-immigrant so you are not suppose to apply for h1b or gc. Your TN could be revoked or renewal can be denied next time. Once you apply for perm, the gc. You can no longer apply for TN. So you need to meddle sure you have enough time remaining on you TN and you cannot leave the US while you wait. Since she is Indian the wait time is 10 years. The TN will absolutely expire during that time. She will be out of status/no visa and then need to leave. If she stays she will be overstaying/illegal. So TN to GC is not possible for Indians or chinese folks. That leaves option 1 and 2. In both cases she doesn't need Canadian citizenship and waiting for Canadian citizenship will be useless and just delay her getting started down the path of H1b->gc or marrisge->h4->gc. Since it will take a long time to get GC in her case, skip Canadian citizenship and just start working on getting married or a job.
Are you also Indian?
Yes
Then you both will eventually have an arranged marriage
Note than TN visa is NOT a dual-intent visa. So she’ll eventually have to go the H1B route if she wants to stay permanently by obtaining a green card. And then you’re back to the country of birth crap.
By that time I’ll get I140 and she can be a dependent if I get the green card? ain’t getting that in next 15 yrs tho
i140 with f1 is dead end as your country of birth is India
Big question here is why aren’t YOU moving to Canada?
Couple of reasons. There aren’t much opportunities in canada Pay is less and taxes are high. We want to stay in usa for next 15 years and move back to canada/india depending on the situation.
I wonder how do people become so mature and settle down at such a young age.
What makes her think she will even get an H1B? She should get her Canadian citizenship since she is so close. If she is that important to you, move to Canada for a few years or you both could return home and start your lives together there.
As somebody who’s been through all this, don’t give up a PR/citizenship if you want stability in North America. Both of you can always come to the US on TN and then H1B but you don’t know the future. Today getting a Canadian PR and citizenship seems easy but they’re already tightening criteria’s and increasing the qualification scores. As an Indian wanting to work in North America, always keep your options open.
H1B isn’t required, you can go direct from TN to GC. Agree on aiming to get citizenship or Canadian PR first though, everything will be much easier.
It isn’t misinformation. That is correct though, you don’t want an old priority date if you’re doing TN to GC. The entire process must be completed while your TN remains valid, and you can’t refresh your TN once you submit the the request to change status.
Keep the girlfriend close to you if you don't want to lose her to someone else
Here's my 2 cents, move to Canada with her, both of you get Citizenship, then move to and forth between US and Canada as you see fit. This is the most safest way you get to keep the girl as well as the opportunity to remain in North America. In the US, tomorrow you can get fired in a bear market and be forced to leave, then you lose both your job and the girl.
You could also find a US girlfriend and get a GC through her. That's what my immigration lawyer recommended me

If she's Indian, it is worth waiting to get the Canadian citizenship before moving to the US.
@OP, this is a no brainer…. Plan for the long term vs the short term
Why? It’s not like getting Canadian citizenship helps with getting US green card. They look at country of origin to decide the queue, not country of citizenship
