Have you read goggles, fb, insta, Twitter, Amazon, T&C to see if they are using your private data for their gains?
The difference is their goal of using user data to replace roles/reduce pay of users providing the data
Private repos are paid for. So, MSFT would be stealing if it was scraping private repos.
GitHub free accounts get private repos too (introduced a couple years back I think)

We treat the content of private repositories as confidential, and we only access it as described in our Privacy Statement—for security purposes, to assist the repository owner with a support matter, to maintain the integrity of the Service, to comply with our legal obligations, if we have reason to believe the contents are in violation of the law, or with your consent. So in short, no. It would be very dangerous to do so anyway. Since repositories might not only include code.
Github is treated by Microsoft as a completely separate entity, so noone at Microsoft would have access to your git hub repository anyway. Github employees might for the reasons disclosed in the privacy statement only.
