Green card process at Google vs Microsoft

I have been working at Microsoft for about two years. They applied for PERM but it got audited. Now I am thinking of switching employers and abandoning this application. Will my audit stick if I apply with a different employer? I had an offer from Google and I reached out and the recruiter said there is still a position and we can speed up the hiring process by going to final round. She also said that Google can start GC processing from day 1. From your experience was Google any different from Microsoft in regards to GC application? Is it a good idea to let go and jump to another company or should I wait? My priority date is current, but the audit adds an extra 4-5 months to the process. Thanks #greencard #google #microsoft #workvisa

Its better to ask google to wait as their offer is valid for one year and in the mean time get i140 in premium and jumpships

Don't you have to wait for 6 months after i140?

Microsoft podadey Jan 14, 2022

Usually but most of the companies are not cancelling or revoking i140s Again the safe is to wait for 6 months.

What triggered the audit?

Microsoft yuriastr OP Jan 14, 2022

They don't disclose the information unfortunately...

That sucks. Sorry man

PERM is position specific, so by switching company you will have to start it over. Not worth it IMO.

The process should be same at both the places, and arnd 10-15% of the application gets audited as per my lawyer, so depends a bit on luck too. Having said that I have had couple of friends at MS get audited too while none of the people I know at Google so far. These are just anecdotes though.

Interview with google and decide later. Both are safe options if you get G offer. Stay at MS and wait for 6 months to join. Join G, and start over GC. Decide about tradeoff after G offer.

Remember that recruiter would say anything to get you onboard. They are also generally clueless about immigration process. If you feel settled and stable at MS, I'd stay and get that GC before looking to move on (I actually did). But that's me, I prefer playing safer and taking less risks like worse manager, misfit team, underwhelming project, etc.

Perm audit adds 6 months to timeline. After that i140 and i1485 if op is row will take another year

You are right. Sorry I was talking about both. Op will have to wait for 180.days after i1485 to leave or ride it out till gc

You say your date is current. Had it been waiting for an i140, there isn't much at stake. But you have the possibility of filing for a i485 in a few more months. So just wait it out I guess

If perm is audited. Perm processing will take 1 year from perm file date. Then i14o and i1485 concurrent filling. Yeah I think op should accept Google and push start date out if Google offer valid for year

PERM through employers is not the best option. If you have a graduate degree and a strong resume then apply through National Interest Waver (NIW) you will get your GC in 12 months.

Microsoft yuriastr OP Jan 14, 2022

That's an interesting idea 🤔 I think I need to look more into this.

but only with a master's, I heard it's tough unless you have an outstanding research/publication record.

IMO, keep interviewing. I am sure with google, there will be a team match and hiring committee. It’ll take time. If by that time, your audit comes through, wait for a few months and then change; or else change at the time and wait for the new filing.
