H1 B transfer Process

Once H1 B transfer is approved with an employer, is it mandatory to join the employer? What happens if I wish to stay longer at my previous employer? What if there’s a third employer also willing to file a transfer? Can I do that with an approved H1B transfer?

Not mandatory to join the new employer. Can continue to work with the current employer as long as they have not revoked your current H1b. You can have a third or 300 more employers file for an H1b for you. There is nothing called as H1b transfer. Each of them is a new H1b petition without H1b cap

Firstly H1b transfer is simply a cap-exempt brand new H1b petition since you’ve already been through the lottery once. You don’t have to join the new employer even after approval. As long as your original employer’s petition is not withdrawn you can stay with them. A third employer can also file for H1b transfer in this case. Usually lawyers ask for ALL your prior H1b submissions and approvals to put in your h1b application packet. I was in the exact same boat 3 years ago.

You can also work for more than one employer , needing each employer filed your H1B and paying you on W2
