Hi, if my H1-b petition was transferred to a new company, can I cancel the transfer or change it back to stay with my current company? I got an offer from a new company and I accepted and transferred the H1-b but now I regret doing so and I don’t wanna go :(
What is your current visa status ? H1b ? I don’t think you can transfer h1b petitions to new company. You can transfer an approved H1B Visa though .
H1b transfer is not really a transfer, it just means they are applying a new h1 for you. So you eventually end up with two H1s. And then when you switch you give notice to old company and they then revoke your h1. So if you change your mind just tell the new company you had a change of heart. From legal standpoint it's totally fine.
You can have many h1b at the same time. And they’re totally separated. You can work for all of them legally.
Correction : you can’t work for all of them, but for “any” of them
There is no complication however not a good practice with the new company as you may burn bridges . But u can decide to stay back
OP says h1-b petition was transferred, can you transfer petitions as well ? Or you can transfer only approved h1b’s ?
So there are no concepts of transfers each are new h1 b applications so the h1 from my current company can be active and I may get another approved From a new company and another from company c and then decide I stay back on my same company . Now for company b and company c may decide to cancel those eventually but somewhere I read at any given point one person can have 3 active h1bs on file
