I understand that as a H1B holder you cannot be unemployed for more than 60 days. Is my understanding on this correct : If a H1B employee working for employer A has the last working day on a given date and then has a 2 week gap before joining employer B. After a given period of time the H1B employee wants to switch from employer B to employer C , at this time does the maximum days of being unemployed remain 60 days or will it be 48 days ( Accounting for the 2 week gap). Also how would it work if the employee were to go from employer B back to employer A ? TC : 187k #h1b
No. It resets to 60. It’s 60 days per i797
Thanks, so when you move from employer B back to employer A, that will be a new i797 right? You can't use the previous valid i797?
Don’t know
If you have valid H1B approval which was never revoked after leaving company A, you can go back and work for the remainder of valid period.
60 days. Count resets
