H1B Layoff

What happens if I get laid off while on H1B?

Amazon god Oct 28, 2019

You get another job or you go home 😂

Wow! That’s like slavery!

Amazon CCI Oct 28, 2019

I'm sorry to hear that you're enslaved when you go home. Not every country is free like America I guess!

You have 30 days to find a new job and start it after your last day at old company. Practically somewhat longer duration also works.

That’s not enough time

VMware lftl00 Oct 28, 2019

Your employer will give you a decent notice period, usually 1-2 months. But yea it is what it is.

Well you signed up for h1b.. why are you acting like a cry baby when you are forced to face reality? What are you hoping for?

You can always go to Indian Consulting Companies

Find another job within 60 days or leave the country or change to another visa.

Cisco NnMk28 Oct 29, 2019

I heard there are some shell companies allowing you to “bench” for a few months while looking for jobs. So tecnically, you are still employed.

Microsoft tghky Oct 29, 2019

If you have a proof, report to immigration. There is nothing like that.

Bloomberg offByOme Oct 30, 2019

Employed in H1B terms means you have pay stubs at the wage level as per your application. So I doubt such ‘shell’ companies can even exist, how do they make money?

Quantcast Kid0h Oct 29, 2019

Been through this. You do not have 30 days or 45 days or “N” days to get a job. You can be in this country as long as your visa is valid. If you find a job within 45 days your h1b transfer is pretty straight forward. Beyond that it is a grey area and you may or may not have to re-enter the country. Upto the immigration officer. Alternatively you could file a COS to b1. But then you have only 6 months as b1 entry is valid for 180 days. My advice, talk to lawyer in this situation. Will be surprised with alternatives and how much shit rumors are out there

Damn. This guy found the loophole

Barefoot Networks Pnxv63 Oct 30, 2019

Been there done that. Our entire team was laid off without notice on the same day but was lucky enough to get a job offer within a week after layoff but the company that gave me an offer took over 3 weeks(LCA+paper work) to file my H-1B and didn't allow me to join on receipt and asked me to wait till approval. It was over 45 days before I can join new employer. One of my friend was out of job for 3 months but still got his H-1B approved with I-94. He was laid off during Thanksgiving time and it was February when he got a new job.
