Hi everyone, I have offers from Amazon and Google (undergoing team match). My H1B got approved (i797a) with COS this year (2021). I just read on various articles that I can't apply for H1B transfer until Oct 1 ( 1st week ) Is it true? If yes, will Google/ Amazon wait for the next 3-4 months for this to happen. I really don't want to miss out on the golden opportunity especially Google. If not, did anyone get denial/rejected H1B transfer. Has anyone faced this issue as well? I am having sleepless nights thinking about this. #h1b #immigration #google #amazon Update - G did file the H1B transfer for me before Oct 1 (around mid Aug) specifying my start date after Oct 1. I didn't know this was possible until they filed it. So please talk to your immigration team before panicking. They know routes which most of us don't. Good luck to everyone who are in the same boat.

Wait until the transfer is approved. Google should be ok to wait another 3 months before applying for a H1B transfer for you, not sure about Amazon. Better to say yes to both and take your chances.

Are you sure about it? Do you have any such case around you that happened? I am getting mixed answers for this.
Mine was transferred in July, but that was a few years back.
Theoretically H1B can be transferred before Oct 1st with COS, but it doesn’t mean Google law firms will do it. Large companies are usually on conservative side about initiating the process if they feel risk.
Yeah that is what I was thinking. Maybe I should bring this up with my recruiter as well after my team match and they can connect me to the immigration team. I hope they don't revoke my offer due this. Since I told the recruiter I can join after 2-3 weeks of offer. Years of efforts would be down the drain.
Adding I used this tactic (getting connected to immigration team - got connected but to an internal SME vs the actual law firm), recruiter may make a big fuss but it's what you need to know.
I was in this situation previously (past couple years). Lawyers needed at least 1 paystub from my H1B sponsoring employer dated AFTER Oct 1 as evidence for my package. Their view was paystubs prior to the H1B effective date (i.e. Oct 1 and after) would not be accepted as sufficient evidence / likely to trigger RFE. Made this clear to Amazon we'd need to wait until mid-October and they waited 3-4 months, in the meanwhile package was tee'd up so that as soon as I had sufficient paystubs, it was submitted and cleared quickly.

No he can not transfer until October first. It needs to be active
Ok, so he can transfer. H1B will get kicked in starting Oct 1st. He will have to work on his current Visa/EAD until then.
