Hi all, I am currently on L1B visa working at Microsoft. Microsoft is gonna apply for my H1B next year and i will receive the results in April. Recently i have been approached my multiple companies in the bay area. I am wondering if i give interviews and get an offer in some other company who will apply for my h1B again before joining, will that account for 2 applications on my behalf? Does that double the chances of me getting an H1 or USCIS only considers one application out of the two?
It’ll increase your chance of getting RFE and also rejection especially you are submitting two applications in the same year. I’m on H1b and I think the rule of thumb here is to play within rules and don’t think you are smarter than USCIS.
This is incorrect. I had 3 applications filed from 3 different employers in same year to increase lottery chances. It is well within the rules.
Sadly it’s just you didn’t get caught but doesn’t mean this is what’s allowed. Also it’s also this kind of behavior that made the H1b experience so disgusting for the rest of those people who applied just once.
Each petition is unique. So you can definitely double your chances of getting selected in lottery if you file 2 applications. No risk to you as it is the company filing for your visa and not you

There are no such rule currently that prevents filing multiple application for a candidate from different employers. However, the rule is expected to change this year when employer will be asked to login to the uscis portal first to put together all the applications alongwith candidate passport no and salary. USCIS would then perform some algorithm to select brightest and highest paid candidates from that pool. This is proposition in progress but if that goes into practice, I would not advise multiple filing.
How long have you been on L1B ? Can’t they extend the visa? I am surprised you are switching to H1B.
He cannot switch company on L1b.
They are extending, but need h1 for switching companies.
