H1B employee transfer RFE.

I got an RFE for employee transfer petition. Company: one of FAANG Role : SDE1 Lawyer: Fragomen RFE date : August 8th Reason : USCIS asked correlation between my academic credentials and job duties. I have an undergrad and grad degree in Computer science. I am shocked to get an RFE for the above reason. Do you suggest to join the company with receipt number ? HR inclines me to this but few posts here scares the shit out of me, when they decline the petition people are undirected. Fragomen associate replied me saying it takes approx 8 weeks to reply to the RFE, isn't it a huge delay or is it how Fragomen operates? I accepted the offer 2.5 months ago, It's really frustrating with all this going on for another 3 months. Please help.

Don't join without receipt number. If the hr puts pressure on put pressure back on them and inquire about what was wrong with the application.

The hr just wants to get you to the company so that he/she can show that they did their job. After that you are not their problem, they do not care if you get rejected or have to return back to your country.

They are willing to wait until it gets resolved, I wanna move out ASAP too. Regarding the application, they said, this RFE is not uncommon these days given the immigration scenario. I am amazed by the time will be taken by Fragomen.

Don’t join on receipt. Ask them to file for premium processing if they really need u sooner. If things go south, you’ll loose everything. But your company will just find another slave and move on.

Don’t start on the receipt. I do immigration for my company, and UCIS has been giving RFEs for almost all of our H1B transfers for Product roles. There have been more denials than ever before (not at our company, but know of some from within my network, usually with reason that the degree isn’t directly related to the role (even though there is no such thing as a Product Management degree). You don’t want to risk being out of status. If you have 3+ years of experience, I would recommend that their legal team get an educational evaluation (they use support letters from previous companies to prove that your experience equals at least a minor degree in your job field. There are many companies starting to sue USCIS for their recent denials for product transfers, as they are based on zero evidence. Most of these companies have been winning their law suits
