Hi everyone, I’m in a weird situation. My h1b didn’t get picked and my company moved me to Canada last year. This year company where I’m working lets call it ‘A’, files my h1b it gets picked. Now here’s the situation I’m in, there’s layoffs happening across our business and our sister teams have been affected, my manager won’t give me a straight answer. 1. If I get laid off before my company files for petition, does that mean my h1b is gone? 2. If A files my petition and hopefully it gets approved before I get fired, does that mean I will have h1b even if they fire me. In this case, lets say I interview and get a job at ‘B’ and ‘A’ fired me but I got the h1b petition approved, in this case the only option remaining is h1 transfer from A to B but I wont be working at A since I got fired. Any advice please on both situations? Thank you.
You will lose H1B either way if you are fired before OCT 1st. It is ideal to have 3 paychecks after Oct 1st but anything before that is miss.
