Except that it’s not. H1B is a non-immigrant visa where you can have an immigrant intent. That means it lets you apply for a GC (and be approved for 2 out of 3 steps) and renew it forever. By definition forever is not temporary. If having to renew something makes it temporary, then even a GC is a temporary visa because you have to renew it every 10 years. There is actually no way you can get a EB GC in US without being on a non-immigrant visa. No employer ever is going to directly apply for a GC for a person before the employee being able to work for them as it’s a two to three year process. A lot of folks from countries not named India go from F1, J1 and numerous other categories of temporary visas to a GC. Also, folks who support 7% country caps in the name of diversity are also mistaken. Every single EB GC goes to someone who is already working in the US. Every GC petition is an adjustment of status! You can’t affect the diversity of working population in the US by the country caps on GCs. It is decided way earlier when US employers choose to hire folks. All you are doing by limiting 7% country caps is giving unlimited GCs to folks from other countries to come to the US and get EB3 GCs directly from F1 Visas. But I guess it’s fine to have a spot reserved for someone not even born yet and save it from someone from India living in the US for two and a half decades with American values, paying taxes, contributing to social security and helping the economy. Lastly, what’s with the blame? If someone is offering you interesting work and a fair price for your labor, you are going to take it. If you didn’t have the privilege to be born in the US, you’d do the exact same thing. So, yeah you can still continue dunking on poor folks uprooting their lives (a lot of who are Americans and parents of Americans), but at least do it fully aware of the actual situation. #h1b #misc

Have you ever thought that J never had the chance to get an H1B because some people of particular ethnicity are constantly abusing the system? Why nobody ever talks about this? How would you feel if you could not even get an H1B because of the system abuse? How would you feel if your only options were to either leave the country or find the 1 in 1000 employers that would accept to file for your GC from a nonimmigrant visa while you are taking a huge risk doing this?

There needs to be country caps on H1Bs. That would eliminate the greencard queue and maintain the diversity intent. It is hard to obtain a work visa in India as the country is protecting jobs for Indian citizens. Why should the US be different?
