There is nothing like activating your H1B. H1B comprises of 2 things, 1. I-797 which is work authorization document. You need it to be able to work legally in US. 2. H1B visa stamp, this is required to reenter in US If either one of this is declined you cannot work legally in USA To answer your question, H1B can be transferred irrespective of stamping. You will need stamp to reenter in case if you exit US for any reason. But always consult your attorney and immigration specialist.
What paypal said is correct. But generally speaking, you should avoid filling the transfer before landing here. (Also, Technically there's nothing like a transfer. It's a fresh petition)
Thanks! I’m now in US and NOT planning to leave right now. So sounds like if now I get new employer then I can transfer H1B, but can my new employer file H1B COS so that I can avoid leaving US? Or new employer must stick to consular process?
