Hello Team Blind, Currently, I have an H1B with employer A. I initiated an H1B transfer with future employer B and the petition got approved. I have not yet stamped my H1B with current employer A or any employer if that matters. (F1 -> H1B) I was thinking to get H1B stamped before I join employer B, while still being employed with A. Just weighing my options and need help with the following - 1. Would you recommend leaving US in such a situation? Having two I-797s be an issue? 2. If I visit home - with which employer would I get my H1B stamped? Current employer A or future employer B? 3. Should I mention about the other employer in the interview/PoE? Have asked attorneys, waiting to hear back. Current TC - 165k YoE - 2.5yrs TIA #h1b
Well, it can get tricky if they put your case on admin processing which could take months. Will future employer wait? Nobody knows.
Makes sense. I don’t think B would wait that long. So you would recommend to not leave US until I join B. My plans are tentative and have no real urgency to go home/leave US. Just trying to make an informed decision.
Join company B, work there for a few months and then make plans.
A) this isn’t a “conundrum” it’s a problem you created for yourself B) you need an immigration attorney, not strangers on Blind.
