H4 EAD

Hi all, my husband got an offer from Meta and wants to move to the US. Currently we’re in Canada and are Canadian PR holders. We’ll be eligible to apply for citizenship in another 2.5 years. I’m really sceptical about the processing time for H4 EAD and honestly very scared of being unemployed. I was wondering if someone’s can shed light on the EAD wait time. Is it worth waiting for citizenship and going via the TN visa route or is it worth moving right away and start a new life in the US Current Company: TCS TC : 100k CAD #workvisa #h1b #rfe #ead #meta #facebook #h4ead #h4eadprocessingtime #h4visa

Why not take remote work from Canada .. meta has remote roles there until you get citizenship

Yes we could go that route but we’re worries we’re loosing out on money good weather and a social life. We don’t have anyone here

Which part of Canada are you in? I’m joining Meta as well and talking to them about moving the in the other direction (US to Canada).

Your husband can go. You can stay behind now. Best of both worlds

Best! @OP, I’d give anything to trade places with you lol. Stay back for 2.5 years - meet up with husband once a month!

Did he get h1b? How will be come to US? L1 visa? If so you will get automatic ead

CoQP83 OP Feb 3, 2022

He hasn’t gotten it yet. But he is considering telling the recruiter that we want to move. Does Meta apply for L1?

Meta randomgod8 Feb 3, 2022

Not sure, I am on h1b with priority date of 2015 for my green card. I have canada pr and thinking of moving there as I am not going to wait forever for my gc.

H4ead is horrible, been waiting for 11 months for my wife now

CoQP83 OP Feb 3, 2022

This has been my scepticism. That is a nightmare truly. Can I dm you for details?

Is it 11 months since your perm got approved or is it 11 month’s since you landed?

Amazon CEOofBlind Feb 3, 2022

H4ead = pure pain. Get that Canadian citizenship or at least get your own H1b

New
CoQP83 OP Feb 3, 2022

Did it take too long for you or your wife?

Amazon CEOofBlind Feb 3, 2022

Yes, we applied 6 months before it expired. It wasn’t coming so we requested expediting - that was denied. She had to stop working. Her company applied for her H1b, we flew all the way to India, got that stamped and she resumed work. That was in 2019. The issues are twice as bad now. You do NOT want to be at the mercy of USCIS if you have an H4EAD.

Amazon yolobolo Feb 3, 2022

First of all get your education right. Your husband will not get L1 visa and also Meta will not apply for H1B for him as it takes a lot of time and it is lottery. The only option your husband has is remote job.

CoQP83 OP Feb 3, 2022

His recruiter said that Meta would apply for an H1B if we decided to move to the US. The draw is in April so I think we still have time

Amazon yolobolo Feb 3, 2022

You can try that but it is like gambling. I would suggest to take remote path and wait for your citizenship. Then move on TN visa.

Goldman Sachs fMkk50 Feb 3, 2022

You can keep your Canada PR after moving to USA

New
CoQP83 OP Feb 3, 2022

No you can’t. In order to maintain PR status you need to stay in Canada for 2 years in a span of 5 years

Amazon huluhul Feb 10, 2022

Not necessarily. You can still work for a Canadian company in the US and accrue those 2 yrs. Companies like Shopify, Lululemon etc

Credit Suisse vptr Feb 3, 2022

I don't think you can apply for H4-EAD right away...the primary H1 holder has to be here for quite some years before spouse can apply for H4-EAD I don't know why you folks are thinking of RSU price and timing when you should be focusing on the immigration thing....TN visa option is better ...

Okta oktaa Feb 3, 2022

You will first need to get an h1b and then and approved i140 to apply for h4ead. Getting approved i140 can take min of 1 year.

New
CoQP83 OP Feb 4, 2022

With premium processing it takes 15 days

Microsoft rbmU56 Feb 4, 2022

But you can only file I140 after your spouse's Perm is approved, which takes at least a year at the moment

Microsoft yijiuy Feb 4, 2022

In the same boat. Husband is moving to Seattle, while I am in Vancouver. DM me.
