My understanding is that she cannot. If she had an EAD before and that expired, and current one is pending, that's when this rule applies. Happy to be told I'm wrong though.
She cannot work without ead. This settlement does not help first time ead applicants .

No. Read it again, it’s pretty much self-explanatory. This doesn’t help H4 ead first time applicants (besides possibly speeding up approval process).
I read l2's do not need to apply for ead at all. Isn't that so? Not sure why it would be different for l2 or h4. The process so far has been the same.
L2 and H4 are different..L2 by default were always eligible for work authorization and had to apply 765. H4 never had this rule unless primary h1 is in advanced stage of 485.. so hence these new updated rules are different for both even though process looks same
