We're applying for h1, h4, h4 ead renewal in premium processing. H1b will happen in 1 month but h4 and ead are going to take 6-10 months. In this case, while h4 and ead are pending, can the spouse travel outside and get h4 stamped at consulate based on approved h1b i797? What happens to pending h4 and ead renewal in US in this case? Curious to know if anyone has been through this situation. TC - 500k
You need to apply for EAD again after getting stamping. P.S I have never done this .
U have to reapply for h4 EAD as i94 will change. Better don’t apply for h4 and h4 ead now. Get h4 stamping outside US and do standalone h4ead. This way, it could be faster.
Interesting. Do you know if they automatically cancel the pending h4 and ead or do we have to apply for cancellation and renewal ourselves?
They do cancel it automatically. But, I don’t know what happens to the filing fee.
Same situation about pending H4 extension, can my spouse travel to India? What are the options to travel back to US by the time H4 with USCIS is still pending? Not worried about EAD at this point.

I don’t know about EAD, but I know for sure that if your current H4 application in the US is pending under Change of Status, if your spouse travel out of the US, that application is considered abandoned.
Thanks that's my understanding too. Do you know if that creates a problem in h4 approval at consulate? Btw it's extension of status not change of status in this case.
no problem at the consulate. In fact i don’t think they even know that you have the other application. My case is a COS
