How to proceed after not winning H1b at first try (Qualcomm)

Hi Blind folks 🙋, Unfortunately, I did not win the H1b lottery this year and I am still on OPT (first year, will extend to STEM OPT this upcoming weeks). Prior to Qualcomm, I was a contractor and started the process for Eb2 (National Interest Waiver) but since I work for Qualcomm, I have not submitted my career summary to my attorney (Ellis Porter) since Qualcomm applied for my H1b (and possibly Green Card once I will obtain H1b). Quick info: Ellis Porter has guaranteed a full refund, if my I-140 will not be accepted My question is, should I proceed with the Eb2 or wait until next year for another try in the lottery? Do you suggest to switch law firms (like Fragomen etc.) My background is as follows: European Citizen Ph.D. in Wireless 120k base 70k RSU 35k sign on

Do you have to pay for Ellis Porter? If so, please check with Qualcomm Immigration team to see if Fragomen will do NIW for you.

What happens, if I-140 will be rejected? If I work with Fragomen, in the future for NIW, will the rejected I-140 affect my new case with them?

Did you discuss that with Ellis Porter? Or another neutral third party? Will frog file NIW for you at all? One can have multiple 140s filed, as far as I know.

Let Qualcomm do your EB-2. Ask Ellis Porter to refund you the fee paid. I used Ellis Porter for my NIW and it got denied. Later my company got my EB-2 approved. I regret wasting lots of time and the filing fee applying NIW with Ellis Porter. I should’ve asked my employer to do my EB-2 in the first place.
