Received my approved I140 couple of weeks ago. As I received my Canadian PR, I may move to Canada within 6 months. Will Amazon revoke I140 when I leave the company? And, just in case, if I re-enter USA after couple of years, will my PERM date still be valid or do I need to start fresh with my employer? #amazon #greencard
If you stay with the company for 6 months after your I-140 approval date, there in no chance for the employer to revoke or cancel I-140. If you do stick to Amazon for 6 months after approval, you keep the I-140 and your priority date for ever or until another I-140 is filed (but the priority date still holds).
I see. I had an idea that one needs to be in USA to ensure that I140 is valid. But if you leave USA and come back then need to start fresh. Glad to know that it is not the case.
You just restart the whole process, but retain your PD. That’s how immigration attorney companies make money tho....if no restart is required all those BAL/Fragomen folks will go unemployed.
Did you get your Canadian PR via EE? Mind asking what’s your CRS score, age and YOE?
If your leave your employer and it’s past 6 months without revoking is the I140 still valid ? For example : I140 approved in January 2020 and I left the country /company In feb 2020. After June 2020 the Company doesn’t revoke the I140 would it be still valid ?
Yes, the company can revoke an i140 when you leave less than 6 months after approval. Otherwise there’s no chance to revoke and it stays active.
Congrats dude. Probably the only green card you will get in N. America if you are from China or India. See you in the promise land
China doesn’t have that long of waiting queue compared to India.
