I94 expired, H1B extension might get denied, what are my next steps?

I am asking this to be prepared for the worst situation (which might happen looking at current immigration situation in my company): 1. Can I re-apply from India? If I do, will it go through lottery again? 2. Do I have to stay with the same employer to apply without going through lottery? 3. Or any other employer can file my H1B from India again with or without lottery? GC process has not started yet. #h1b

First time H1b, applied in Apr 2018, approved in Feb 2019, was valid till Dec 2019. Regular Extension filed Sept 2019. Waiting for response. No RFE yet.

Why was it valid for a year only? Usually itโ€™s 3 years

Guessing this is your first extension and that you still have at least 3 more years on your current H-1B. 1. Yes. No. However, it'll be difficult to interview from India. 2. No. 3. Yes and without lottery since you'll be cap exempt. Make sure you check with a lawyer. There may be some other options as well like switching to some other visa. Good luck!
