My I 94 expires last week and I just discovered it. My H1b is valid for another 10 months and my pasport at the last POE also has the same date. What options do I have at this point? Do I need to go back to India to get my H1b visa stamped?
Your i94 is what matters.. if this is just an error in i94 you may be ok. You should consult with your immigration attorney ASAP
Will have to wait until Tuesday now
Did your company file a H1B extension? If so, the new I94 is attached at the bottom of your approved I797 - https://www.quora.com/H1B-Visa-extension-approved-but-I-94-and-current-Visa-expired-over-the-passport-What-is-the-next-step
Looks like I misread your post. How do you have an I94 that expires before the visa or the passport? I94 should be valid till the visa expires or till your passport expires, whichever comes first
I changed employers and the i94 shows my date of expiry based on the last employer. The new H1b visa gives me another 27 months of work time.
The new petition should have your new I-94.
The CBP officer entered the wrong date. Previous stamps had the correct expiration date. Just read about Nunc pro tunc provision for expired I 94. Since this only a week old it should be hopefully resolved without leaving the country
You can go to any cbp office at an international Airport and provide a petition with documents to correct your i94. I've done this once when immigration officer got a date wrong. However, at this point, your easiest bet is to travel abroad and renter. Overstaying i94 is not allowed.
How can I-94 expire?
???? They all expire
It happened to me once. I had to go to the CBP at San Jose airport to correct it. They working hour for I94 correct is strange. Make sure you get it right before you go.
Did you go to CBP after your I 94 has expired?
Yep.
I’ve stayed like that so many times in my past 17 years on h1. It will be good to get it corrected. But I’ve stayed with my i94 expired and visa valid many number of times. It gets corrected next time when you get stamped and enter the country. However it is not preferred. This is because many a times the cbp officer enters the wrong date or extension doesn’t give you i-94 attached. It’s not a serious problem.
You stayed on h1b for 17 years?!
How did you get it corrected? Email/phone/in person at one of cbp locations?
