Hi, This post is for anyone who is personally in this process or who knows people who are in the H1B Visa process and it’s taking a toll on them with the additional pressure of layoffs. I've been in the tech industry for years, and I've seen firsthand the stress and frustration that comes with navigating the H1B visa process. The uncertainty, the paperwork, and the never-ending wait can take a toll on your professional and personal life. It's a struggle shared by many in our community. Personally, as a result of the recent decline in the tech industry, I found a temporary job in an immigration law firm through family connections. Thanks to this experience I have become a bit more knowledgeable about certain forms of immigration, and frankly when I learned about this lesser-known option I realized it can be a game-changer for some people with the credentials and background like those of many people working in tech. I’m going to share what I learned so far, and I encourage you to do your own research… There’s a visa called EB2 NIW. “NIW” stands for “national interest waiver” and the most important aspect of it is that professionals with the right qualifications can waive the requirement of a job offer and apply for residency directly. For anyone who is frustrated with the H1B process and the lack of job flexibility that comes with it, this alternative offers a chance to bypass the labor certification process and potentially expedite the path to a green card. Having seen people working in my own team wrestle with the competitiveness of the H1B process, I understand the anxiety that comes with it. The EB2 NIW route might be the solution —offering a smoother transition towards permanent residency. Hopefully this information is helpful…I think this could be an opportunity for a lot of people and full disclosure I am in the process of pivoting my career from tech to legal services through my own consultancy for STEM professionals in the tech sector who want to leverage this avenue for immigration. What is taken into consideration in the application process is whether or not the applicant demonstrates that 1. That he or she has a proposed endeavor that is of Merit and National Importance (for STEM applicants this is often the case), 2. That he or she is well positioned to a advance the proposed work,3. That on balance or would be beneficial to waive the job requirement.

National interest waiver is for rocket scientists changing the world or doctors saving lives in the middle of deserts or highly cited PhD researchers working on major technological breakthroughs. Code monkeys, teChNiCaL mAnAgers, qUalItY eXpeRtS and excel spreadsheet creators need not apply. NIW lol

NIW is classified as EB2. Look for VISA bulletin. Even for ROW, EB2 is highly backlogged. There is 1.5-ish year backlog now even for ROW. And according to an analysis from Reddit, backlog for EB2 ROW will only get worse. So, you still need H1B. NIW is just a way for you to get priority date sooner than PERM-based EB2.
I am happy to see ROW applying NIW. Let the EB2 backlog grow for ROW. Let them also feel the pain.

You’re equating just any SWE to “national interest” You should go back and review your stance. Because you might feel it equates doesn’t mean it does. This is the same “We SWEs are the most important.” In the face of rocket scientist and other actual important works SWEs are not.
Keep an open mind. Leave if it’s too much. Don’t buy expensive stuff on credit to trick you into a lifestyle problem. YOLO
