This post is for my friend who is currently working in Infosys back in India and got a job offer recently in Accenture. She worked in Infosys for 10 years and received one promotion during the time. After raising e-separation in Infosys, the notice period is for 3 months which is about to complete in a week. Her manager and HR suggested that they can give a hike of 40% if stayed back without any promises for promotion and this happened 3 weeks back. During the last couple of days, they were trying to blackmail her to stay back in the company by saying that they will put a remark that she cannot be hired back under code of conduct as they planned to give her a hike but she still decided to leave. She didn’t receive any letter for hike until now, every conversation happened verbally. Please bare in mind that she got married but living separately due to some personal issues with her husband and currently going through a touch phase in marriage and single earning as she is supporting her family. She is scared that if she joins Accenture and fired there, she won’t be able to get a job and might not be able to go back to Infosys if they put a remark that she can’t be hired back. Is this even legal in Infosys for that matter in any company. I have tried to talk to her to move to Accenture but she is unable to decide with everything going on. Please let us know your thoughts. Collect the evidence and tell them that you’re going to public shame the manager and HR on LinkedIn and proceed legally if they continue doing this. They will run for their lives.
Unfortunately everything is verbal with no email conversations. As she didn’t receive/sign any papers for hike and with good ratings in the past, I don’t think they can really do anything but one can’t be certain. I feel bad for her with all the cheap tricks Infosys is playing right now after working for 10 years for the same company.
I think Accenture is a good option..no point in working for someone who is blackmailing you.There is no guarantee they will hold their ground about the hike.Also you don't know how they will blackmail her in future.Tell her to have optimistic thoughts and not worry about getting fired.If u were hired,it is because they saw something in you!
Companies can decide for themselves if they don't want to re hire. As long as they give a relieving letter without any comments, it is fine. If she declines to join one week before joining date, Accenture too can blacklist her. There are several companies that are comparable or better than Infosys. She won't lose much even if Infosys really blacklists her. No employee in India can drag any company of the size of Infosys to court and win. That makes the whole legality argument irrelevant.
AFAIK, it doesn’t matter what they say. She can understand their nature , blackmailing even after working for 10yrs in the company. Infy doesn’t rehire. That should be fine as there are many other companies out there. I resigned Infy due to a terrible manager and gave same reason in exit interview. My previous manager called me to give another offer after 2-3 yrs. so, I don’t think it matter in few yrs even if they put a remark.
No one should worry about Infosys not rehiring.
Your poor friend. In this scenario, clearly Infosys has treated her poorly and is now trying to get into her head. It's an abusive relationship. 1) No written offer from Infosys, no talk. 2) The question your friend needs to ask herself if she even wants to go back to Infosys. The are thousands of employers, especially tech companies in India. She needs to address her fears and get out of that place. TLDR: they're trying to get in her head. Don't let them.
Also: tell your friend that the fact that she's being offered/blackmailed to stay with a 40% pay hike after submitting her notice, means she's good enough for them to make such desperate (currently unsubstantiated) claims. That means they know they treated her like crap. She deserves so much better, man. Tell her to use that as a flex.
Leave Infosys, the company deserves to die. Peanuts TC and they treat you like crap. I quite literally walked out on my job at Infosys. Had to return later to give back equipment and I verbally quit about 3 weeks later by answering HR calls and telling them. At will clauses rock, I feel sorry for the 3 month notice people in India have to give.
Yeah 3 months notice period even for a junior role is a crime against humanity
After 10 years of commitment if this is what the org gives back, then is there even a question whether she should stay? and why would anyone want to go to such a place? And for your info two service company recruter said they would black list me or something when I rejected there offer. Few months back I got call from both companies.
She needs to take stand as if she show as weak person people will threaten with meaning less things. If required bring in senior HR people or drop email telling that xyz is my last working day as she would have already served 3 months notice. Keep everything in written as words has no value. Let them do whatever they can do. Once you are out why even she care to go back in such company? Also ask her NOT to give this manager reference in her entire career. Be strong and all things will be fine.

Sure but one cannot choose to live their life this way. If she agrees to this threat she will be under their thumb forever, and she already has a better alternative lined up
