So earlier this year Facebook paid out on a PERM violation settlement because they were giving preferential treatment to immigrants over citizens(I actually got paid from this one, yay). Now today Apple is agreeing to settle on the fact their recruiting policies favored immigrants over citizens and green card holders for some positions. Can we just assume they’re all doing this at this point and just haven’t been caught? Shit is shameful.
The perm program does not require employers to mirror their recruitment like they do for normal jobs but they are required to do it in good faith iirc. Amazon for example does post perm jobs on website.
Sure but you can read each of these settlements. Facebook was caught basically posting jobs and then “reserving” them for non-citizens. The Apple one is different since it’s more like you said, different recruitment practices, but the government felt that this difference was giving preferential treatment to non-citizens. People are free to disagree with that conclusion.
For 40 years department of labor and department of justice did not say anything to employees when they were doing the bare minimum
The penalties are pitiful so that's why it keeps on happening.
Exactly, facebook penalty was only 9 million split between 2000 claimants.
That’s true and considering you can be pretty sure not everyone eligible signed up for the class action it affected more people than that. So on a per position/head count basis pretty cheap.
"... in violation of the anti-discrimination provision of the Immigration and Nationality Act (INA). The INA generally prohibits employers from discriminating against workers because of their citizenship or immigration status." https://www.justice.gov/opa/pr/justice-labor-departments-reach-settlements-facebook-resolving-claims-discrimination-against This act is a joke. Ground-zero for discrimination by country is USCIS themselves.
Can you explain how the gov is discriminating by country
Ok. I forgive you for the ignorance on this topic. Please read how US green cards are issued. It's by country of birth.
Where can I sign up for Apple's settlement? I need a new jacket

Indentured servitude isn't brought up enough
Cost savings and increased leverage over the employee since their residency here is tied to their employment.
The threat of losing their job is much harsher so they can run them harder while dangling green card out in front of them.
