Going through pre-employment background check for new job and provided details, but specified *DO NOT CONTACT CURRENT EMPLOYER*, and despite this, they absolutely contacted my current employer. Judging by their general level of incompetence based on other "challenges", etc this is not a sharp bunch doing the check. I don't know if anything is going to happen but I'm pretty pissed. Is this legal? Do I have any recourse? #hiring #hr #interviews #backgroundcheck #idiocy
Hireright is incompetent for sure. How did you find out?
they provide a pretty thorough "report" as the check is ongoing with notes from the checkers, etc.
May be that "do not contact" line provoked them to do a little more investigation
.... it's a standard box that I checked for my current employer.... as in "I'm still employed there, don't shit where I currently eat" ?
Sounds illegal sue the shit out of them
Illegal if you actually specified not to contact your current employer.
Which law specifically does it violate?
Privacy Act of 1974
Don't you have to provide a contact number for each place of employment where they may call
no, they use their own verification network by default I believe.
Hireright is trash
yes legal. you do not have recourse. you should have just put DO NOT CONTACT as the employer name
It should be ok, only HR would have been contacted for the verification. Your manager may have been asked a few questions but he would not know who is asking, all he knows is it came from HR. There are quite a few things your employer may get asked questions about you, like when you receive paternity benefits, audit from IRS, immigration check, college application etc HR wouldnât want to guess who is asking and they itâs normal for them to get verification requests.
If you follow up with legal action, please keep us updated!
If you're leaving, who cares?
...I haven't left yet. What happens if the req blows up, etc? Shit happens.
Did you sign an agreement regarding the background check?
