To Tesla immigrants laid off

To everyone at Tesla who is on OPT or H1B and laid off, while you would see me waiting for this entire company to collapse because of the unprecedented fraud run by its CEO, I have full sympathy for folks who are recent students Little for those who have been working in this company for years. Anyway those who are worried how to get more time on your visa : Tesla should give you some severance. I don’t expect Musk to adhere to that as he didn’t offer severance to Twitter employees and many had to file lawsuits including their ex CEO. But if Tesla gives you severance then effectively that can get you additional few months. How ? A company doesn’t need to have you on payroll to show you work there. Most likely many of you won’t be having system access and access to company now. So you are cut off already. However not on payroll doesn’t mean not active in system. Tesla if it acts like most other companies will automatically show you active internally on workday and even Teams for next two months. While you won’t have system access, but internally your profile can remain active for next two months. This costs company nothing as technically company can say this is for the two months or so severance amount we gave. USCIS just needs that if they ever check. They don’t need you to be on payroll to start your visa clock. They just need to know until when you were active In system internally. So by keeping you active internally for another two months, your visa time clock starts post that 2 Months giving you effectively 4 months post your lay off. This is a very common thing almost all companies do to help those on visa. It cost a company nothing Please talk about this to your HR if they aren’t doing that. Tell them to do this. Every company does it. But if they don’t give you any severance or they have no intent to give you severance as cheating is Musk’s number one forte , then you are kind of screwed. Good luck.

No. Your payroll can stop if company isn’t paying you for next two months. But your profile can still be shown active internally as long as they give Severance and you still don’t work There. Most companies offer payroll for next 1-2 months also but technically I believe profile active internally should do

Not true, USCIS requirement in paycheck and not just being active in the system, else most consultancies will game the system by just keeping you active and not paying you

Why? Read what I wrote. If severance is given then technically a company can say they are paying. Just that they don’t want them to access company systems. Severance amount can be used as an example of paycheck
