We are confident we will prevail in the Delaware Court of Chancery. This topic has been flooded by commentary on this issue that's by non laywers, and is often just a rorschach test of how much they like/dislike Twitter/Elon or if they own stock of Twitter or Tesla. I don’t know who will win but discovery will be interesting on both sides. There is an allegation in Elon’s answer that twitter got to the 5% bot number by having a few employees survey 100 random accounts per day. That seems suboptimal for twitter considering Elon’s public statements about the bot issue and the ad dollars that are spent on the assumption that 95% of accounts are human (humans?).
