I know there are many layoffs happening especially at high growth non-profitable startups. I for one also work at such company and wondering (if any) what type of considerations/options are provided for folks on work visa, where you only have a 60 days grace period? Could anyone who recently got impacted share their stories? So that I can manage my expectations accordingly. #workvisa #layoff #h1b
Noone cares about H1B visa status. They can lay you off like any other employee. It's your hassle to find a new job within 60 days, honestly it's 30 45 days coz you also need time for visa transfer so that you're not just working on receipt and worry about RFE. So again any company (big or small) will fire you and they don't care if you're on H1B.
I can share my story. I am in the analytics space and got laid off earlier this year because the company I worked for went under. Fortunately, I was able to get not one but two job offers within the 60 day grace period. My H1B was transferred over to my new employer without a hitch. But back then the job market was hot so I was able to interview with a lot of companies.
The whole 60 days thing is made up. There is no such thing as a grace period. This is actually a good thing. How? It means they are lax about enforcing it. So 61 days is not the end of the world. Neither is 62 days or 63 or you get the idea. It’s like traffic speed laws. 5 mph over is too petty to be fined for anything. But it’s technically a crime. Same here. Just find a job as early as you can. Don’t think too much of 60 days specifically.

Op don't listen to this. As H1B visa holder there are tons of shit happens. Once you start your application for green card, you gotta mention all your previous job history etc and if there's some time where you were out of status it gets flagged in the system. I have seen a friend getting grilled coz she was working for a consulatancy and was out of status for a week. Her GC got into rfe and then her H1B extension was denied. It's way too common. That being said, I have GC approved but moved back to my home country to enjoy the life and money that I made in USA. I choose to do so so perhaps that's why I am happy here. It's not end of the world. You should dictate the terms of how you want to live your life, not some employer or visa.
Why should they give special preference to H1Bs?

In many cases, there are no special considerations as employers can’t discriminate against citizens and give special treatment to visa holders.
should not it be the other way around: the employer got people to know h1b because they "could not find qualified local staff". If they need to lay off someone, they should lay off h1b first to follow "the spirit of the law". Pretty sure that no one does this, but still.
